Terms & Conditions of Vertriebsimpuls GmbH & Co. KG for training and consulting services.

1. Scope

These Terms & Conditions apply to all training, coaching, consulting and speaking services provided by Vertriebsimpuls GmbH & Co. KG, Münchner Freiheit 26, 80802 Munich, Germany, hereinafter “Vertriebsimpuls”, to entrepreneurs within the meaning of Section 14 BGB (German Civil Code). Any deviating terms of the client apply only if Vertriebsimpuls has expressly agreed to them in writing.

2. Contract formation

The basis of the work is an individual proposal from Vertriebsimpuls. The contract is formed when the client accepts the proposal or when Vertriebsimpuls confirms the assignment in writing, by email or by starting to provide the service. The content and scope of the services are set out in the relevant proposal or order confirmation.

3. Services

Vertriebsimpuls provides services in B2B sales training, Business Coaching, sales consulting, talks and keynotes. The services are provided with the care expected of a proper specialist company. No specific commercial success is owed unless it has been expressly agreed. Dates, location and format are agreed by mutual consent.

4. Fees

The fee is based on the relevant agreement in the proposal. All fees are subject to statutory VAT. Travel and accommodation costs and other ancillary costs are charged as agreed. Unless agreed otherwise, invoices are payable without deduction within the period stated on the invoice.

5. Cancellation

Agreed dates may be cancelled or postponed free of charge up to 14 days before the date. For later cancellations, Vertriebsimpuls may charge the agreed fee proportionately if the time released cannot be used elsewhere. Saved expenses will be deducted. An alternative date may be agreed at any time.

6. Liability

Vertriebsimpuls has unlimited liability for intent and gross negligence and for damage arising from injury to life, body or health. In cases of ordinary negligence, Vertriebsimpuls is liable only for breach of essential contractual duties, limited to the typical and foreseeable damage under the contract. The client is responsible for implementing recommendations and training content.

7. Special terms for consumer book purchases

In deviation from Section 1, this section applies to purchases of the book “Potential: Beschwerde” by Achim Jaeger through this website by consumers. Under Section 13 BGB, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or independent professional activity. The contracting party is Vertriebsimpuls GmbH & Co. KG, Münchner Freiheit 26, 80802 Munich, Germany.

Ordering and payment take place through a payment page hosted by Stripe. The purchase contract is formed as soon as you complete the paid order there and we confirm it. The stated price includes statutory VAT. The amount of the shipping costs is shown to you in checkout before you complete the order.

Right of withdrawal for consumers

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us, Vertriebsimpuls GmbH & Co. KG, Münchner Freiheit 26, 80802 Munich, Germany, phone +49 89 97 89 43 40, email info@vertriebsimpuls.de, of your decision to withdraw from this contract by a clear statement, for example a letter sent by post or an email. You may use the model withdrawal form below, but this is not required.

To meet the withdrawal deadline, it is sufficient for you to send the notice that you are exercising your right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we must repay all payments we have received from you, including delivery costs, except for the additional costs arising because you chose a type of delivery other than the least expensive standard delivery offered by us, without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no case will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have sent back the goods, whichever is earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen day period expires. You bear the direct cost of returning the goods. You only have to pay for any loss in value of the goods if that loss in value is due to handling that was not necessary to check the nature, properties and functioning of the goods.

8. Place of jurisdiction

The law of the Federal Republic of Germany applies. If the client is a merchant, a legal entity under public law or a special fund under public law, Munich is the exclusive place of jurisdiction for all disputes arising from this contract.
